{"id":7623,"date":"2020-01-15T07:41:07","date_gmt":"2020-01-15T07:41:07","guid":{"rendered":"http:\/\/blogs.bath.ac.uk\/edswahs\/?p=7623"},"modified":"2020-01-15T07:41:07","modified_gmt":"2020-01-15T07:41:07","slug":"amending-the-2002-education-act","status":"publish","type":"post","link":"https:\/\/blogs.bath.ac.uk\/edswahs\/2020\/01\/15\/amending-the-2002-education-act\/","title":{"rendered":"Amending the 2002 Education Act"},"content":{"rendered":"<p>18 years on, some people's thoughts turn to the revision or replacement of the 2002 Education Act. \u00a0This is the act of parliament that still governs all schooling in England and it dates from 5 governments ago (although it has been amended once or twice).<\/p>\n<p>I have no idea what is in the minds in the DfE, but the approach of Teach the Future is to ask for an over-arching piece of legislation that would keep the 2002 act in place, presumably unamended.<\/p>\n<p>Others, such as SEEd see changing the act as important. \u00a0What SEEd wants to do is to\u00a0add a clause to section 78 of the act. \u00a0This currently says:<\/p>\n<p><a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2002\/32\/contents\"><strong><span class=\"LegDS LegP1No\">Section 78<\/span><\/strong><\/a><strong><span class=\"LegDS LegP1No\">\u00a0<\/span><\/strong><span class=\"LegDS LegP1GroupTitleFirst\"><strong>General requirements in relation to curriculum<\/strong><a id=\"section-78-1\" class=\"LegAnchorID\"><\/a><\/span><\/p>\n<p class=\"LegClearFix LegP2Container\"><span id=\"section-78-1\" class=\"LegDS LegLHS LegP2No\">(1)\u00a0<\/span><span class=\"LegDS LegRHS LegP2Text\">The curriculum for a maintained school or maintained nursery school satisfies the requirements of this section if it is a balanced and broadly based curriculum which\u2014<\/span><\/p>\n<p class=\"LegClearFix LegP3Container\"><span id=\"section-78-1-a\" class=\"LegDS LegLHS LegP3No\">\u00a0\u2013 (a)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">promotes the spiritual, moral, cultural, mental and physical development of pupils at the school and of society, and<\/span><\/p>\n<p class=\"LegClearFix LegP3Container\"><span id=\"section-78-1-b\" class=\"LegDS LegLHS LegP3No\">\u00a0\u2013 (b)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">prepares pupils at the school for the opportunities, responsibilities and experiences of later life.<\/span><\/p>\n<p>The proposed new clause is:<\/p>\n<p>\u2013 (c) instils an ethos and ability to care for oneself, others and the natural environment, now and in the future.<\/p>\n<p>In some ways, the proposed new clause fits very well with the existing clause [b] in that they are both pretty vacuous. \u00a0But [c] is so\u00a0vague that DfE could stick it in and it would make no difference in that most schools would say \"Doing that already\". \u00a0After all, a bit of PSHE here, an emphasis on empathy there, a litter picking rota, and an annual visit to a\u00a0local care farm and the job would be done. \u00a0Anyway \u2013 and being slightly picky \u2013 whilst you can instil an ethos,\u00a0I don't see how you can do so for an ability.<\/p>\n<p>But does the 2002 act need to be amended? \u00a0Look at the Act's\u00a0<a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2002\/32\/section\/80\"><strong>Section 80<\/strong><\/a>\u00a0<strong>Basic curriculum for every maintained school in England<\/strong>.<\/p>\n<p>Part [1] of this says:\u00a0<span id=\"section-80-1\" class=\"LegDS LegLHS LegP2No\">\"<\/span><span class=\"LegDS LegRHS LegP2Text\">The curriculum for every maintained school in England shall comprise a basic curriculum which includes (there's stuff here about <span class=\"LegDS LegRHS LegP3Text\">religious education or sex education<\/span>) ...\". \u00a0Part [3] then says:<\/span><\/p>\n<p class=\"LegClearFix LegP2Container\"><span id=\"section-80-3\" class=\"LegDS LegLHS LegP2No\">\u00a0\u2013 (3)\u00a0<\/span><span class=\"LegDS LegRHS LegP2Text\">The Secretary of State may by order\u2014<\/span><\/p>\n<p class=\"LegClearFix LegP3Container\"><span id=\"section-80-3-a\" class=\"LegDS LegLHS LegP3No\">\u00a0\u2013 (a)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">amend subsection (1) so as to add further requirements (otherwise than in relation to religious education or sex education),<\/span><\/p>\n<p class=\"LegClearFix LegP3Container\"><span class=\"LegDS LegRHS LegP3Text\">..., and\u00a0<\/span><\/p>\n<p class=\"LegClearFix LegP3Container\"><span id=\"section-80-3-c\" class=\"LegDS LegLHS LegP3No\">\u2013 \u00a0(c)\u00a0<\/span><span class=\"LegDS LegRHS LegP3Text\">amend any provision included in subsection (1) by virtue of paragraph (a) of this subsection.<\/span><\/p>\n<p>That's to say, the Secretary of State could change the basic curriculum to cover, say, <em>climate and ecological education\u00a0<\/em>by issuing an Order in Council. \u00a0They could then provide guidance to schools along the lines of that recently provided by the New Zealand government (of which more later). \u00a0They have, of course, been able to do this for the past 18 years ...<\/p>\n","protected":false},"excerpt":{"rendered":"<p>18 years on, some people's thoughts turn to the revision or replacement of the 2002 Education Act. \u00a0This is the act of parliament that still governs all schooling in England and it dates from 5 governments ago (although it has...<\/p>\n","protected":false},"author":237,"featured_media":0,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":"","jetpack_post_was_ever_published":false},"categories":[2,4],"tags":[],"class_list":["post-7623","post","type-post","status-publish","format-standard","hentry","category-comment","category-news-and-updates"],"acf":[],"jetpack_featured_media_url":"","jetpack-related-posts":[],"_links":{"self":[{"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/posts\/7623","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/users\/237"}],"replies":[{"embeddable":true,"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/comments?post=7623"}],"version-history":[{"count":0,"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/posts\/7623\/revisions"}],"wp:attachment":[{"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/media?parent=7623"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/categories?post=7623"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/blogs.bath.ac.uk\/edswahs\/wp-json\/wp\/v2\/tags?post=7623"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
