{"id":8429,"date":"2023-09-29T08:31:12","date_gmt":"2023-09-29T08:31:12","guid":{"rendered":"https:\/\/blogs.bath.ac.uk\/edswahs\/?p=8429"},"modified":"2023-09-29T08:31:12","modified_gmt":"2023-09-29T08:31:12","slug":"charity-begins","status":"publish","type":"post","link":"https:\/\/blogs.bath.ac.uk\/edswahs\/2023\/09\/29\/charity-begins\/","title":{"rendered":"Charity begins"},"content":{"rendered":"<p>I see that the Labour Party has abandoned its plan to remove charity status from independent schools. \u00a0This is not because of a Damascene change of heart, but because it has discovered that a change in the statutory definition of \u201ccharity\u201d would be necessary. \u00a0This, it seems, and who could have guessed it, might have implications for the whole charity sector. \u00a0Given that the party is stuffed full of lawyers, this took a long time. \u00a0It also suggests a loss of institutional memory about the problems caused when Labour introduced the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Charities_Act_2006\">2006 Charities Act<\/a> which was subsequently used by the Charity Commission to hold independent schools to charitable account through a public benefit test. \u00a0The <a href=\"https:\/\/en.wikipedia.org\/wiki\/Suzi_Leather\">Wikipedia page<\/a> of Suzi Leather (Charity Commission Chair at the time) has the details. \u00a0No wonder they have decided not to go down that road again.<\/p>\n<p>The plan remains, however, to add vat to independent school fees. \u00a0This will be \"more straightforward\" than changing the definition of charity we're told. \u00a0The Times quotes a Labour spokesman [sic]: \u201cOur policy remains. We will remove the unfair tax breaks that private schools benefit from, to fund desperately needed teachers and mental health counselling in every secondary school.\" \u00a0If that is, they can get the money out of the Treasury which is atavistically agin hypothecated taxes.<\/p>\n<p>But will this be straightforward? \u00a0The Times quoted a Conservative source: \u201cEducation provision is exempt from VAT, and any law change will lead to a ton of unintended consequences for other teaching providers.
